General terms and conditions
of Rivus watch s.r.o., effective from 1 November 2025
I. Introductory provisions
These general terms and conditions (the “terms”) of Rivus watch s.r.o., with its registered office at Přemyslovců 992/52, Mariánské Hory, 709 00 Ostrava, Czech Republic, Company ID No.: 23616105 (the “seller”), govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, as amended (the “Civil Code”), the mutual rights and obligations of the parties arising in connection with or on the basis of a purchase contract concluded between the seller and a natural person – consumer (the “buyer”) through the seller’s online shop at www.rivuswatch.com (the “website”).
These terms do not apply where the person intending to purchase goods from the seller acts within their business activity or independent profession when concluding the contract.
Provisions deviating from these terms may be agreed in the purchase contract. Such deviating provisions take precedence over these terms.
The seller may unilaterally amend or supplement these terms; the version in effect at the time the purchase contract is concluded applies to the specific contractual relationship.
These terms are drawn up in Czech and English. In case of any discrepancy, the Czech version prevails.
The seller allows the purchase contract to be concluded only in Czech or English and in CZK or EUR.
II. User account
The buyer may register on the website and gain access to a user interface through which they can order goods (the “user account”). Goods may also be ordered without registration.
When registering and ordering goods, the buyer must provide true and complete information and update it if it changes.
The buyer must keep the information needed to access the user account confidential and may not allow third parties to use it.
The seller may cancel the user account if the buyer does not use it for more than 6 months or breaches their obligations under the purchase contract or these terms. The buyer may request the cancellation of their user account by contacting the seller.
III. Conclusion of the purchase contract
All presentation of goods on the website is for information only and the seller is not obliged to conclude a purchase contract for these goods (Section 1732(2) of the Civil Code does not apply).
The buyer places an order by completing the order form. Before sending the order, the buyer can check and change the information entered. By sending the order with the button labelled “Order and pay”, the buyer confirms that they have read and agree to these terms.
Immediately after receiving the order, the seller confirms its receipt by email to the buyer’s address. The contract is concluded when the order confirmation is delivered to the buyer.
The buyer acknowledges that they are obliged to pay the price of the goods; an order placed with the “Order and pay” button constitutes an offer to conclude a purchase contract with an obligation to pay.
IV. Price of goods and payment terms
Prices of goods are final, i.e. including all taxes and fees, if the seller is a VAT payer. If the seller is not a VAT payer, prices are final without value added tax.
The buyer may pay the purchase price in particular:
- by bank transfer to the seller’s account,
- by payment card through a payment gateway,
- by other methods stated on the website.
Card payments are processed through a secure payment gateway. The seller does not come into contact with the buyer’s card details.
The seller may require payment of the full purchase price before the goods are dispatched (Section 2119(1) of the Civil Code does not apply).
The seller issues a tax document (invoice) after the price has been paid and sends it electronically.
All prices remain valid for as long as they are shown on the website. The seller reserves the right to change prices; such changes do not apply to contracts already concluded.
V. Delivery of goods
The seller delivers goods through carriers within the Czech Republic and the European Union.
Shipping costs and any other fees are shown when ordering.
On receipt, the buyer must check that the packaging is intact. If they find a defect, they must record it in a report with the carrier and inform the seller.
The risk of damage to the goods passes to the buyer upon receipt of the goods.
Goods marked “in stock” are usually dispatched within 3 business days of the payment being credited to the seller’s account. The buyer will be informed of the dispatch by email with the tracking number.
Delivery times and costs may vary by destination country; the exact amount is shown when completing the order.
VI. Withdrawal from the contract
In accordance with Section 1829 of the Civil Code, the buyer – consumer has the right to withdraw from the purchase contract within 14 days of receiving the goods. The buyer may send the notice of withdrawal to the seller, among other ways, to info@rivuswatch.com or by completing the form on the seller’s website.
The buyer cannot withdraw in the cases set out in Section 1837 of the Civil Code, in particular for goods made to the buyer’s specification or customised.
If the buyer withdraws from the contract, they must return the goods to the seller without undue delay, no later than 14 days after withdrawal. The buyer bears the costs of returning the goods. Unless stated or agreed otherwise, the buyer sends the goods back to: Rivus watch s.r.o., Přemyslovců 992/52, 709 00 Ostrava, Czech Republic. We recommend sending the goods as an insured parcel.
The buyer is liable for any reduction in the value of the goods resulting from handling them other than as necessary to establish their nature and functioning (Section 1833 of the Civil Code).
The seller refunds the purchase price no later than 14 days after withdrawal, using the same method by which it was received. The seller is not obliged to refund the purchase price before receiving the goods or proof that they have been sent.

The seller is responsible for ensuring that the goods have no defects on receipt and correspond to the agreed description, type and quality.
The buyer must make a complaint without undue delay after discovering a defect. A complaint can be made by email or in writing at the seller’s address. Details are set out in the complaints policy.
